TERMS AND CONDITIONS

In consideration of the Customer purchasing fuel on an automatic delivery basis within the agreed upon repayment terms from Maritime Fuels, our preferred contractor, on behalf of Maritime Fuels, agrees to supply the parts and services under the terms and conditions as contained in this parts/labour plan (the “Agreement” or the “Plan”). The Plan commences when signed by our preferred contractor authorized representative and remains in effect for one year from date of approval and will be automatically renewed unless terminated as set out herein. Account must be within credit terms to receive service as required.

 

The plan does not cover suspended units or units which can fire over 299,000 BTU’s.

 

Commercial customers (Sole Proprietorships, Partnerships, Limited Companies, Trusts etc.) cannot qualify for Commitment Bundle 1. They can, however, pending tank and oil burner equipment inspections, qualify for a no-charge Commitment Bundle 2.

 

The plan includes the following:

  • Customer’s purchasing the Maritime Fuels Bundle 3 are not required to be on automatic delivery.
  • Bundle 3 is not available within the Halifax Regional
    Municipality (HRM) district.*

Parts Replacement & Repair: Our preferred contractor, on behalf of Maritime Fuels, agrees to repair or replace those parts of the Equipment that are covered by the Plan (the “Parts Covered”), as outlined in the Parts Covered section hereof, and which become defective or malfunction due to normal use. Coverage for wood and oil furnace or any other type of duel fuel combination furnace applies only to the parts used for oil burning and does not cover failure of parts caused by the burning of other fuels. (e.g., heat pump or heat pump parts or any hybrid appliance) The coverage under this Plan applies only to heating equipment using standard high efficiency oil burning equipment. The preferred contractor shall be the sole judge of whether a part should be repaired or replaced and whether a new part or one rebuilt to the original specification or an acceptable substitute may be supplied. Parts, labour, and annual cleanings for free standing water heaters are covered under the plan.
• Customer’s purchasing/qualifying the Maritime Fuels Bundle 2 have an annual limit of $1,000 on parts. Customer’s purchasing the Maritime Fuels Bundle 3 have an annual limit of $500 on parts. Both plans have unlimited labour. There is no limit on parts and labour for customers enrolled in Bundle 1.

 

Inspection of Equipment: The preferred contractor, on behalf of Maritime Fuels, reserves the right to inspect and approve the Equipment within 45 days of the effective date of the Plan. The Customer agrees to provide the preferred contractor with reasonable access to the Customer’s premises for the purpose of inspecting the Equipment. Any repairs required to put the Equipment in a condition acceptable to the preferred contractor and to code are chargeable to the Customer at prevailing rates and must be completed and paid in full for coverage under the Plan to continue. Necessary work will be first quoted to and approved by the Customer, before the work is commenced.

 

Emergency Service: Emergency service will be provided 24 hours per day, 7 days per week for no heat or no hot water service due to failure of Parts Covered. General services (including annual cleaning and inspection) is available during the normal business hours (8:00am to 5:00pm Monday to Friday, 310-3776).

 

No heat calls that are found to be the result of an emergency shut-off switch in the off position, blown fuses or breakers supplying electricity to the heating unit and/or oil valves turned off between the oil storage tank and the heating unit will deemed billable calls. Labour will be billed through Maritime Fuels at its prevailing rates.

 

No Run Out Maritime Fuels Commitment: Customer must be on automatic delivery to qualify. Should Maritime Fuels fail to keep the Customer’s tank(s) full, Maritime Fuels commits to providing 900 litres of free furnace oil to the Customer for each automatic delivery run out. The No Run Out Maritime Fuels Commitment Bundle has no cash value and is non-transferable. (Conditions apply. Also please see Excluded Services in the Terms & Conditions.) Applies only to Maritime Fuels Commitment Bundle members only.

 

Exclusions to No Run Out Guarantee:
• Automatic run outs caused by leaking tanks, oil lines or oil filters and product theft are not covered under the run-out guarantee.
• Address must be covered under the Maritime Fuels Commitment Bundle.
• Homes, residences and businesses using secondary sources of heat (for e.g. wood and pellet stoves, heat pumps, solar panels etc.) do not qualify.

 

Excluded Services, Maximum Coverage & Limitation of Liability: This Plan does not provide coverage for service calls for the following and such calls will be charged to the Customer at Maritime Fuels’ prevailing service rates: Humidifiers; bleeding of radiators; dirty air filters; running out of fuel (if not on automatic delivery); removal of water from oil tanks; 24 volt transformers; air filters; warm air zone dampers; power failures; water damage; repair or replacement of duct work or pipes; coils and domestic hot water components; checking heat exchangers for cracks; after hours calls, except for no heat or hot water; power venters and their components; direct vents and their components – chimneys and their components – commercial zone control valves – setback thermostats – in-floor heating components – frozen oil lines and parts that are no longer manufactured. Damages caused by fire, flood, acts of God, storm, accident or any other extraneous causes are not covered by the Plan. There are restrictions on geographic coverage. Ask for details. Oil automatic delivery run outs caused by fire, flood, acts of God, storm, accidents, acts of vandalism, acts of theft, wholesale supply interruptions or any other extraneous cause are not covered under the oil No Run Out Maritime Fuels Excellent Service Promise.

IT IS UNDERSTOOD AND AGREED THAT MARITIME FUELS’ LIABILITY AND CUSTOMER’S SOLE REMEDY, WHETHER IN CONTRACT, UNDER ANY WARRANTY, IN TORT (INCLUDING NEGLIGENCE), IN STRICT LIABILITY AND UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR ANY OTHER DIRECT OR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PROPERTY DAMAGE, DAMAGE TO OR LOSS OF EQUIPMENT, LOST PROFITS OR REVENUE, COSTS OF RENTING REPLACEMENTS AND OTHER ADDITIONAL EXPENSES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL REMEDIES WHICH MIGHT OTHERWISE ARISE BY IMPLICATION OR OPERATION OF LAW ARE HEREBY EXCLUDED AND WAIVED.

 

Purchase of Maritime Fuels Home Heating Fuel: The Customer is required to purchase heating fuel from Maritime Fuels during the initial term and any renewal term of this agreement.

 

Maritime Fuels Plus Bundles: Customers on Budget Billing plans are not automatically enrolled in our Maritime Fuels furnace insurance plans. Protection Plans are offered exclusive of budget billing. The Maritime Fuels Commitment Plan Bundle One is offered free of charge when the following conditions are reached:

  • 12-month budget plan (EFT bank account only).
  • Statements delivery tickets and invoices are received by the customer through email.
  • Must be on automatic delivery.
  • Minimum consumption of 1200L per year for Commitment Bundles 1 and 2.
  • Only oil-burning equipment used in a residential application qualifies for the plan(s). All commercial applications are excluded unless approved by Maritime Fuels Ltd. Management.

 

Termination: Either the Customer or Maritime Fuels may terminate this Agreement by giving 30 days written notice of the termination to the other party. This Agreement will automatically terminate (a) If the Customer uses heating fuel other than that supplied by Maritime Fuels, (b) If the Equipment is repaired, replaced or altered other than by an authorized Maritime Fuels service person, and (c) if the Customer refuses to allow Maritime Fuels to inspect the Equipment or to complete any repairs required to put the Equipment into an acceptable condition as required by Section 2 hereof. In the event of automatic termination, the customer shall not be entitled to the return of any payment made under this agreement. Any customer canceling their account within the first year of the plan coming into effect may get billed at current market prices for any service and/or parts at the complete discretion of Maritime Fuels Ltd.

 

Customer Report Obligations: The Customer is required to notify Maritime Fuels of any: (a) problems with the Equipment covered by this Agreement; (b) service to or alteration of the equipment not performed by Maritime Fuels or its preferred contractor; and (c) use of heating fuel in the Equipment other than that, supplied by Maritime Fuels.

 

Ownership of the Equipment: The Customer confirms that all heating Equipment, oil storage tanks, and oil lines are the property of the Customer.
**Electronic Monitors remain the property of Maritime Fuels. The equipment must be returned to Maritime Fuels in proper working condition (normal wear and tear excepted) upon cancellation of the account.

 

Terms of Payment: All customers with Commitment Bundles must have credit terms. Amounts owing under this Agreement are payable in accordance with the Customer’s payment terms with Maritime Fuels, as set out in application form and/or pre-authorization form completed and signed by the Customer and submitted to Maritime Fuels. The Plan contains the entire agreement of the parties hereto (other than payment terms) and there are no promises, representations, warranties, conditions or obligations other than those printed here. The division of this Agreement into sections and the use of headings are for convenience of reference only and shall not affect the construction or interpretation of this Agreement. If a Customer breaks their credit terms, or in the case of Maritime Fuels Bundle 1 customers if the Customer puts the account on a “selfautomated” delivery schedule, Maritime Fuels reserves the right to charge all service calls, parts and labour for the past 12 months.

 

Customer Acceptance: I understand and agree to (1) purchase home heating fuel from Maritime Fuels as required by this Agreement, and (2) all other terms and conditions of this Agreement as printed on all pages of this agreement.
