TERMS AND CONDITIONS

In consideration of the Customer purchasing fuel on an Automatic Delivery basis within the agreed upon repayment terms from Maritime Fuels, our preferred Contractor, on behalf of Maritime Fuels, agrees to supply the Parts and Services under the Terms and Conditions as contained in this Parts and Labour Agreement. The Agreement commences when signed by our preferred contractor authorized representative and remains in effect for one year from date of approval and will be automatically renewed, unless terminated as set out herein. Maritime Fuels reserves the right to alter or make changes to the Agreement at any time within the Agreement. Account must be within credit terms to receive service as required.
Under the terms of the Service Agreements, this version supersedes all existing agreements. Notification of changes to the agreements will always be posted on the Maritime Fuels website.
The Agreement does not cover suspended units or units which can fire over 249,000 BTU’s.
Commercial Customers (Sole Proprietorships, Partnerships, Limited Companies, Trusts etc.) cannot not qualify for Service Bundle 1 or 2
The Agreement includes the following:
Parts Replacement & Repair: Our preferred contractor, on behalf of Maritime Fuels, agrees to repair or replace those parts of the equipment that are covered by the Agreement (the “Parts Covered”), as outlined in the Parts Covered section hereof, and which become defective or malfunction due to normal use. Wood and oil furnace or any other type of dual fuel combination furnace (e.g., heat pump or heat pump parts or any hybrid appliance) are not covered under this agreement. The coverage under this Agreement applies customers only to heating equipment using standard high efficiency oil burning equipment as their primary source of heating. The preferred contractor shall be the sole judge of whether a part should be repaired or replaced, or an acceptable substitute may be supplied. Annual cleanings for free standing water heaters are covered under the Agreement.
Customer’s purchasing/qualifying for the Maritime Fuels Bundle 2 have an annual limit of $1,000 on parts and labour.
Inspection of Equipment:
The preferred contractor, on behalf of Maritime Fuels, reserves the right to inspect and approve the Equipment within 45 days of the effective date of the Agreement. The Customer agrees to provide the preferred contractor with safe and reasonable access to the Customer’s premises for the purpose of inspecting the equipment. The maximum age for the equipment under the agreement will be 25 years. Any repairs required to put the equipment in a condition acceptable to the preferred contactor, and to current code, are chargeable to the Customer at prevailing rates and must be completed and paid in full for coverage under the Agreement to continue. Necessary work or the equipment replacement will be first quoted to and approved by the Customer before the work is commenced.
Emergency Service:
Call for service must be limited to regular business hours for work to be covered by the agreement unless the heating system has a complete mechanical failure where the Customer has no heat or hot water.
Non-Emergency requests outside of regular business hours on weekdays (8am – 5pm) will be billed accordingly to the Customer. No heat calls that are found to be the result of an emergency shut-off switch in the off position, blown fuse or breakers supplying electricity to the to the equipment and/or oil valves turned off between the oil storage tank and the heating unit will be deemed billable. Labour will be billed by Maritime Fuels at its current rate.
No Run Out Maritime Fuels Commitment:
Customer must be on Automatic Delivery to qualify. Should Maritime Fuels fail to make delivery and there is a run out, Maritime Fuels commits to providing a $500 credit to the Customer’s delivery account. The No Run Out Maritime Fuels Service Bundle has no cash value and is non-transferable. (Conditions apply. Please see Excluded Services in the Terms & Conditions.) Applies only to Maritime Fuels Customers under the Service Agreement.
Exclusions to No Run Out Guarantee
– Automatic run outs caused by leaking tanks, oil lines or oil filters and product theft are not covered under the run-out guarantee.
– Address must be covered under the Maritime Fuels Service Bundle.
– Homes, residences, and businesses using secondary sources of heat (for e.g., wood and pellet stoves, heat pumps, solar panels etc.) do not qualify.
– Deliveries not made due to Customers account being placed on hold because of current credit status.
Excluded Services, Maximum Coverage & Limitation of Liability:
This Agreement does not provide coverage for service requests for the following and will be invoiced to the Customer at Maritime Fuels’ prevailing service rates:
Humidifiers; bleeding of radiators; draining or modification of the heating system in order to repair/replace a covered part (e.g., expansion tank); bleed and start equipment requests for non-automatic delivery; oil tanks and their components; removal of water from oil tanks; 24 volt transformers; air filters; warm air zone dampers or warm air units connected to dual occupancy location; power failures; water damage; clean-up of oil spills or leaks due to heating system, oil line or tank repair or replacement of duct work and/or components; Hot water components (including mixing valves, and coil); repair or replacement of heat exchangers; non-emergency after hours requests; power or direct vent systems and their components – chimneys and their components – zone control valves or proprietary zone valves – setback thermostats or programable thermostats – in-floor heating components – frozen oil lines or heating system freeze ups even if due to a failure of a covered part – parts that are no longer manufactured or not sourced from a Maritime Fuels supplier – Parts replaced due to failure to scheduled annual Maintenance with Maritime Fuels contractor – Warranty replacement of equipment. Damages caused by fire, flood, acts of God, storm, accident, or any other extraneous causes are not covered by the Agreement. There are restrictions on geographic coverage for service requests. Ask for details. Oil automatic delivery run outs caused by fire, flood, acts of God, storm, accidents, acts of vandalism, acts of theft, wholesale supply interruptions or any other extraneous cause are not covered under the Maritime Fuels No Run Out Guarantee
IT IS UNDERSTOOD AND AGREED THAT MARITIME FUELS’ LIABILITY AND CUSTOMER’S SOLE REMEDY, WHETHER IN AGREEMENT, UNDER ANY WARRANTY, IN TORT (INCLUDING NEGLIGENCE), IN STRICT LIABILITY AND UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR ANY OTHER DIRECT OR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PROPERTY DAMAGE, DAMAGE TO OR LOSS OF EQUIPMENT, LOST PROFITS OR REVENUE, COSTS OF RENTING REPLACEMENTS AND OTHER ADDITIONAL EXPENSES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL REMEDIES WHICH MIGHT OTHERWISE ARISE BY IMPLICATION OR OPERATION OF LAW ARE HEREBY EXCLUDED AND WAIVED.
Purchase of Maritime Fuels Home Heating Fuel: The Customer is required to purchase heating fuel from Maritime Fuels during the initial term and any renewal term of this agreement.
Maritime Fuels Bundles: Customers on Budget Billing and automatic delivery are not automatically enrolled in our Maritime Fuels service agreement. These are offered exclusive of budget billing. The Maritime Fuels Service Agreement Bundle One is offered free of charge when the following conditions are reached:
– 12-month budget plan (EFT bank account only).
– Statements delivery tickets and invoices are received by the customer through email.
– Must be on automatic delivery.
– Minimum consumption of 1800L per year for Service Bundles 1 and 2.
– Only oil-burning equipment used in a residential application (single or double occupancy) will qualify for the service Agreement.
Termination: Either the Customer or Maritime Fuels may terminate this Agreement by giving 30 days written notice of the termination to the other party. This Agreement will automatically terminate (a) If the Customer uses heating fuel other than that supplied by Maritime Fuels, (b) If the Equipment is repaired, replaced or altered other than by an authorized Maritime Fuels service person, and (c) if the Customer refuses to allow Maritime Fuels to inspect the Equipment, perform annual maintenance or to complete any repairs required to put the Equipment into an acceptable condition as required by Section 2 hereof. In the event of automatic termination, the Customer shall not be entitled to the return of any payment made under this agreement. Any customer canceling their account within the first year of the Agreement may be invoiced at current cost for any completed service and/or parts at the complete discretion of Maritime Fuels Ltd.
Customer Report Obligations: The Customer is required to notify Maritime Fuels of any: (a) problems with the Equipment covered by this Agreement; (b) service to or alteration of the equipment not performed by Maritime Fuels or its preferred agreement or and (c) use of heating fuel in the Equipment other than that, supplied by Maritime Fuels.
Ownership of the Equipment: The Customer confirms that all heating Equipment, oil storage tanks are the property of the Customer.
Terms of Payment: All customers with Service Bundles must have approved credit terms. Amounts owing under this Agreement are payable in accordance with the Customer’s payment terms with Maritime Fuels, as set out in application form and/or pre-authorization form completed and signed by the Customer and submitted to Maritime Fuels. The Agreement contains the entire agreement of the parties hereto (other than payment terms) and there are no promises, representations, warranties, conditions, or obligations other than those printed here. The division of this Agreement into sections and the use of headings are for convenience of reference only and shall not affect the construction or interpretation of this Agreement. If a customer disregards their credit terms, or in the case of a customer under Maritime Fuels Bundle 1 placing the account on a “self-automated” delivery schedule, Maritime Fuels reserves the right to charge all service calls, parts, and labour for the past 12 months.
Customer Acceptance: I understand and agree to (1) purchase home heating fuel from Maritime Fuels as required by this agreement, and (2) all other terms and conditions of this agreement as printed on all pages of this agreement.
